Estate Planning
We work with clients to create personalized estate plans that reflect their unique needs and family dynamics. Whether clients require a revocable living trust, a will, or both, Nelte Law is ready to help. Establishing a revocable living trust helps to create a smooth transition after your passing and avoid interference from the probate court. We will ensure your revocable living trust is properly funded and that pay-on-death beneficiaries are named on your accounts to reduce the risk of probate. Additionally, establishing a will ensures your assets are distributed according to your wishes and that guardians are appointed for your minor children.
Advance Care Planning
It is important to have the following documents in place in the event of your incapacity: a Durable Power of Attorney, an Advance Health Care Directive, and a HIPAA Authorization. Execute a Durable Power of Attorney to designate the person you wish to manage your financial affairs if you become unable to do so. Create an Advance Health Care Directive to appoint someone to make health care decisions on your behalf if you are incapacitated. Execute a HIPAA Authorization to allow your physician to release your health care information to individuals of your choice. This typically includes your agent under the Advance Health Care Directive and your family members.
